These Terms of Service ("Terms") govern your use of sell.applesauce.chat ("Sell Applesauce", "the Service", "we", "us"), operated by applesauce.chat. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms apply to all visitors and users who access the Service, including those who authenticate via email-based magic links or use listing generation features.

Sell Applesauce is a photo-to-listing tool for resellers. You upload photos of items; the Service uses AI to analyze them and generate listing text, suggested prices from eBay sold-listing research, and shipping rate estimates via Pirate Ship.

1.2 — Acceptable Use

You agree to use the Service only for lawful purposes and only to list items you own or have the legal right to sell. You agree not to:

• Upload photos of or create listings for stolen, counterfeit, prohibited, or illegal items
• Use the Service to harass, defraud, or deceive buyers or third-party platforms
• Attempt to reverse-engineer, scrape, or extract the Service's underlying systems
• Violate the terms of service of eBay, Facebook Marketplace, or any other platform
• Submit content that infringes the intellectual property rights of others

We reserve the right to suspend or terminate access for any violation of these provisions.

The Service uses email-based magic link authentication via the Resend API. When you sign in, we send a one-time login link to your email address. No password is created or stored.

2.1 — Freemium Access

You may use up to 3 item analyses without creating an account. After that, authentication is required to continue using the Service.

2.2 — Account Responsibility

You are responsible for maintaining access to the email address used for authentication. Any activity through your authenticated session is your responsibility. Notify us immediately if you suspect unauthorized access.

2.3 — Account Data

We store account-related data as described in our Privacy Policy. You may request deletion of your account and all associated data at any time via /data-deletion.

All listing text, descriptions, category assignments, condition assessments, and price suggestions are generated by AI and provided for informational purposes only. They are not guaranteed to be accurate, complete, or suitable for any marketplace.

3.1 — Your Responsibility

You are solely responsible for reviewing all AI-generated content before use, including:

• Verifying that descriptions accurately represent the item's condition and contents
• Confirming that suggested prices are appropriate for your item and market
• Ensuring listings comply with target marketplace rules
• Correcting any inaccuracies or hallucinated details before publishing

3.2 — Price Research Disclaimer

Suggested prices are derived from eBay sold-listing data and serve as a starting reference only. Actual market values vary by condition, timing, location, and demand. We make no representation that any suggested price reflects fair market value or will result in a sale.

3.3 — No Warranty on AI Output

AI-generated content is provided "as is." We disclaim any warranty that such content is accurate, non-infringing, or fit for any particular purpose.

Listing generation is available. Manual copy-paste posting to eBay and Facebook Marketplace is supported. Direct eBay API posting is planned.

4.1 — Your Responsibility for Posted Listings

You remain solely responsible for all content in any listing you create or post using the Service, including accuracy of description, legality of the item, compliance with marketplace policies, and fulfillment of any resulting transaction.

4.2 — Third-Party Platform Terms

Your use of generated listings on third-party marketplaces is subject to those platforms' terms of service. We are not liable for any suspension, penalty, or restriction imposed on your marketplace accounts.

4.3 — Future Automated Posting

We may introduce automated posting features that publish listings directly to marketplaces on your behalf. When available, each automated post will require your explicit initiation. We do not guarantee that any automated posting attempt will succeed, and we are not liable for failed, delayed, or incorrectly formatted postings.

The Service is free to use under a freemium model. You get 3 free item analyses without an account. After that, a free account is required. No payment information is collected.

5.1 — Future Paid Tiers

We may introduce paid subscription tiers or per-use fees in the future. If we do, we will provide advance notice of pricing and included features.

5.2 — Shipping Cost Estimates

Shipping rate estimates shown in the Service are provided via Pirate Ship integration and are estimates only. They do not constitute a binding quote. Actual postage costs at time of purchase may differ. We are not responsible for any discrepancy between estimated and actual shipping costs.

6.1 — Your Content

You retain all ownership rights to photos you upload and listings you create. We claim no intellectual property rights over your content.

6.2 — License to Operate

By using the Service, you grant us a limited, non-exclusive, royalty-free license to process, transmit, store, and display your content solely as necessary to provide the Service. This license terminates when you delete your content or close your account.

6.3 — Our Intellectual Property

The Sell Applesauce application, including its software, design, and underlying systems, is the property of applesauce.chat. Nothing in these Terms grants you rights to our codebase, trademarks, or other IP beyond the right to use the Service as described herein.

6.4 — AI Output Ownership

Listing text generated by the AI in response to your photos is provided for your use. To the extent any such output is copyrightable, we assign any interest we may hold in it to you.

The Service integrates with the following third-party services. Your use may be subject to their respective terms and policies.

7.1 — OpenAI

Photos you upload are transmitted to OpenAI's API for AI-powered analysis and listing generation. OpenAI's data handling is governed by the OpenAI Privacy Policy and Terms of Use.

7.2 — Resend

We use the Resend API to deliver magic link authentication emails. Your email address is transmitted to Resend for this purpose. See Resend's Privacy Policy for details on their data handling.

7.3 — eBay

Price research features access publicly available sold-listing data from eBay. Future features may include direct listing via eBay's API. We are not affiliated with or endorsed by eBay Inc.

7.4 — Pirate Ship

Shipping rate estimates are provided via Pirate Ship's API. Queries containing package dimensions and weight are transmitted to Pirate Ship. See Pirate Ship's Terms of Service. We are not affiliated with or endorsed by Pirate Ship.

7.5 — Meta / Facebook

Generated listings may be used on Facebook Marketplace at your discretion. Future features may include direct Marketplace integration. We are not affiliated with or endorsed by Meta Platforms, Inc.

7.6 — No Liability for Third Parties

We are not responsible for the availability, accuracy, or conduct of any third-party service. Disruptions to third-party services may affect functionality, and we are not liable for any resulting impact.

To the fullest extent permitted by law, Sell Applesauce and applesauce.chat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

8.1 — No Guarantee of Results

We make no guarantee that using the Service will result in a successful sale, accurate pricing, or any specific outcome. The Service is a tool to assist you; results depend on factors outside our control.

8.2 — Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8.3 — Aggregate Liability Cap

In jurisdictions that do not permit complete exclusion of liability, our total aggregate liability shall not exceed twenty-five US dollars ($25).

9.1 — By You

You may stop using the Service at any time. To request deletion of your account and data, visit /data-deletion.

9.2 — By Us

We may suspend or terminate your access at any time, with or without cause, including for violation of these Terms.

9.3 — Effect

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive — including limitation of liability, intellectual property, and governing law — shall survive.

We may modify these Terms at any time. Material changes will be reflected in the "Last Updated" date above. Continued use after modification constitutes acceptance. The current version is always available at sell.applesauce.chat/terms.

These Terms are governed by the laws of the United States, without regard to conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of courts in the United States.

If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary; the remaining Terms remain in full force.
